ATTENTION CELL PHONE USERS

LITTLE ROCK, AR - November 7, 2008:  Emerson Poynter LLP is a leader is consumer class action litigation against the cellular telephone industry.  Over the past seven years, our law firm has been extensively involved in multiple cases against the cell phone industry that involve coverage problems, false advertising, hidden charges in bills, and early termination fees (or early disconnect penalties).  Our clients are sick of being nickled and dimed every month.  And moreover, they are tired of paying too much for poor service, and feel like they are being held hostage by their provider’s early termination fee. 

Early termination fees, and hidden charges have been the subject of numerous articles, and debate at the Federal Communications Commission (“FCC”).  Indeed, the industry has sought the protection of the FCC, and wants it to basically immunize cellular telephone companies from such wrongs.  Championing the cause for consumers has been Senators Amy Klobuchar (D-MN) and Jay Rockefeller (D-WV) as they introduced the Cell Phone Consumer Empowerment Act of 2007, which was aimed at empowering the 200 million cell phone customers   nationwide  and   cause  the   industry  to disclose their services and charges before customers sign long-term contracts, provide a thirty day window to exit a contract, and even provide greater flexibility to leave a cellular telephone service provider that isn’t meeting the consumer’s needs.  See, http://klobuchar.senate.gov/newsreleases_detail.cfm? id=281970.
